REGULATIONS

DETERMINING THE CONDITIONS FOR THE SERVICE OF PASSENGERS AND TRANSPORT OF PEOPLE AND ITEMS IN THE PUBLIC TRANSPORT (LOCAL PUBLIC TRANSPORT) ORGANISED BY THE MUNICIPAL TRANSPORT AUTHORITY IN KIELCE

I. GENERAL PROVISIONS

  1. The present Regulations set out the rules for use by passengers transport services within public transport in Kielce and municipalities with which the inter-municipal agreements were concluded concerning the local public transport, organised by the budget of the City of Kielce - Municipal Transport Authority in Kielce.
  2. The terms used in the Regulations have the following meaning:
    1. Public transport – transport services provided at the request of ZTM [Municipal Transport Authority] as part of regular public transport lines, in accordance with the publicised timetables;
    2. Transport organiser – a budgetary unit of the City of Kielce, appointed by the Council of the City of Kielce for the organisation and management of public transport in Kielce and in the municipalities covered by the inter-municipal agreements in respect of local public transport, hereinafter referred to as the Municipal Transport Authority or abbreviated ZTM;
    3. Operator – the carrier providing under the agreement with the ZTM transport services in respect of local public transport (public transport);
    4. Vehicle – means of transport used by the Operator in the public transport, with all the necessary documents certifying its admission to traffic;
    5. Transport – transport of people and items carried out by Operators under the agreement with the ZTM;
    6. Passenger – any person who has entered into a contract of carriage;
    7. Bus stop, stop – marked with the relevant road signs place for passengers boarding or exiting the vehicle at the given line;
    8. Transport document – a document allowing a passenger to travel by means of public transport;
    9. Timetable – publicised, determined on the basis of the Transport Law schedule, according to which the arrivals and departures are to be held;
    10. E-card – an electronic card which is, inter alia, the carrier of public transport ticket, of information on the entitlements for a discount / free fares and also of the payment function operating as a prepaid card.
  3. In matters not specified in these Regulations, the provisions of applicable law, in particular the Act of 23 April 1964 the Civil Code (that is Journal of Laws Dz. U. of 2014 item 121, as amended), the Act of 15 November 1984 on the Transport Law (that is Journal of Laws Dz. U. of 2012 item 1173, as amended), the Act of 16 December 2010 on the public transport (Journal of Laws Dz. U. of 2011 No. 5, item 13, as amended) and orders issued by the President of the City of Kielce shall apply.

II. RULES OF PUBLIC TRANSPORT SERVICES USE:

  1. Passengers using public transport services are obligated to observe the following rules:
    1. Passengers may use public transport services in Kielce only on the basis of the transport documents which are e-cards or paper tickets with a printed note Zarząd Transportu Miejskiego w Kielcach, ZTM Kielce or ZTM.
    2. The passenger is obliged to have a valid ticket/e-card for a whole ride and to present it to ticket inspectors on demand.
    3. During a ticket inspection, the passenger is obliged to display a valid ticket/e-card and/or a document entitling him/her to a discount or free ride.
    4. The passenger is not allowed to hand over to other person a validated single fare ticket which is used by this passenger or has already been used in the public transport so that this person could use this ticket again to travel in the public transport.
    5. The passenger is obliged to validate her/his ticket immediately after boarding the vehicle, and if the passenger does not possess any ticket, he/she should buy a ticket in the ticket machine, and if it is out of order, the passenger should buy it from the bus driver and validate it; or if the passenger is in possession of an e-ticket, he/she should place it in front of the validating machine/reader device to register the ride.
    6. While exiting the vehicle, the passenger should place the e-card in front of the validating machine/reader device to de-register the ride. Ride de-registering is not required in case of season e-tickets.
    7. In case of problems connected with registering e-card in the validating machine, the passenger should use the other validating machine. In case of failure, the passenger should buy a paper ticket and report this situation to the Ticket Sale Point run by ZTM.
    8. A ticket is considered to be invalid if:

a) it is damaged so that it is impossible to read:

- in the case of tickets to be validated (single fare, 60-minute and 24-hour tickets) – the data which are recorded by the validating machine on a ticket during its validation that could allow a ticket inspector to   determine the validity of the ticket,

- in the case of tickets not to be validated (season tickets or bearer tickets) – the data relating to the personal data of the ticket owner and the date of its validity in the case of a season personal ticket, and in   the case of a bearer ticket – the date of its validity,

- in the case of an electronic ticket - the data stored on the ticket;

b) a single fare, 60-minute and 24-hour ticket has not been validated

c) a single fare, 60-minute and 24-hour ticket has been validated more than once, and on the basis of the data recorded on the ticket during its validating it results that it has already been used to travel

d) a single fare, 60-minute and 24-hour ticket has been validated wrongly, i.e. it has been validated in such a way that for reasons not related to the validating machine, it is impossible to read the data recorded by     the validating machine on the properly validated ticket which allows the inspector to establish whether the passenger travels with a valid ticket or not;

e) it is expired,

f) a single fare ticket has been handed over to the other passenger by the passenger who travels with a valid ticket.

9. E-card is invalid if:

a) it is damaged,

b) it is not registered in the system,

c) it is expired.

10.  The passenger, who during the control cannot present the valid ticket/e-card for a ride or an appropriate document, is obligated to pay the appropriate fare for a ride and additional charge.

11.  Taking a seat in the vehicle means the conclusion of the contract for transport.

12.  Boarding and exiting the vehicles is only possible at the bus stops or stations.

13.  The vehicles used by the operator for the provision of transport services go according to the timetables placed at the organiser's bus stops and website.

14.  Carriage of items and animals can take place under the conditions set out in the order rules applicable in the municipal regular passenger transport.

III. TICKET PURCHASE REGULATIONS AND THE SCOPE OF ENTITLEMENTS FOR HOLDERS OF DIFFERENT TYPES OF TICKETS:

  1. All kinds of tickets may be purchased at the Ticket Sale Points run by the Municipal Transport Authority in Kielce.
  2. One fare tickets, 24-hour tickets and 60-minute tickets may be purchased in ticket machines as well as in other generally available sale points which sell tickets.
  3. E-tickets may be topped up at the Ticket Sale Points, ticket machines and online.
  4. If the ticket machine is out of order and the passenger cannot buy a ticket, there is a possibility to purchase one fare tickets from the bus driver for the exact amount of money.
  5. A single fare ticket entitles its holder to one ride and to travel by one means of transport on the whole route.
  6. A 60-minute ticket entitles its holder to the ride with the possibility to change the means of transport for the period of 60 minutes from the first date and the first validation of the ticket.
  7. A 24-hour ticket entitles its holder to several rides within 24 hours from the first date and the first validation of the ticket.
  8. A personal ticket for all bus lines entitles the person named on the ticket to travel on all bus lines for the period for which it has been purchased.
  9. A bearer ticket for all bus lines entitles its holder to travel on all bus lines for the period for which it has been purchased.
  10. An e-card entitles its holder to travel on all bus lines, and the fare is electronically charged and its amount depends on the number of bus stops travelled.
  11. A passenger with an e-card is entitled to a discount if he/she within 15 minutes from exiting the bus continues travelling by means of the other bus:
    1. if the passenger travels for the distance of more than 8 bus stops on the first bus, the fare will not be charged at the ride registration when travelling on the next bus,
    2. if the passenger travels up to 8 bus stops on the first bus, the supplementary fare - the appropriate for the total number of stops, will be charged at the ride registration when travelling on the next bus
  12. To obtain an e-card, the Applicant should visit the Ticket Sale Point (PSB) and have the following:
    1. the document with a photograph confirming the Applicant’s identity,
    2. the completed form,
    3. the latest photograph (35mm x 45mm),
    4. the documents confirming the type of discount and the period of its validity in accordance with the separate regulations.
  13. Season personal and bearer e-tickets may be purchased for the period of 14, 30, 60 and 90 days on any selected day.
  14. If the passenger cannot use the season e-ticket due to justifiable reasons beyond her/his control for the period of at least 7 days, the passenger may receive a refund of part of paid fare proportional to the period during which he/she could not use this ticket; the ticket price valid for the period during which the passenger used the ticket will be the base price for the calculating the refund. The refund of part of money for the ticket is possible if the passenger visits the ZTM Ticket Sale Point before starting to cease to use the ticket and submits the appropriate application.
  15. In case of loss or theft of an e-card it is possible to issue a duplicate upon prior payment of PLN 10.00 and satisfying conditions included in Article 12.

IV. TICKET INSPECTION REGULATIONS:

  1. The ticket inspection is carried out by the inspectors who are in possession of identifiers issued by Zarząd Transportu Miejskiego in Kielce.
  2. The ticket inspection starts as soon as the ticket inspectors make sure that there are no passengers standing at the ticket validators who intend to validate their ticket/register their e-card.
  3. When the ticket inspector starts the inspection, she/he informs passengers of this fact and asks them to prepare their tickets to be inspected.
  4. During the ticket inspection, the passengers show the ticket or e-card to the ticket inspector to check its validity and in case of free or discount fare rides, the passengers should present any document confirming this entitlement.
  5. The ticket inspector is equipped with the e-card control device called the reader device. On the reader device screen there are seen basic details concerning the ride registration, e-card details and registered tickets.
  6. The reader device emits the following kinds of sound:
    1. single sound – at least one ticket/ride has been registered during a given route;
    2. triple sound – no registered tickets/rides during a given route.
  7. If the e-card is blocked or the passenger is not able to confirm his/her right to the e-card use, the ticket inspector is obligated to retain the e-card and hand it over to the ZTM Ticket Sale Point to obtain explanations.
  8. In case of the lack of a valid ticket or the lack of an electronic purse registered validation or the lack of the document entitling to free or discount fare ride, the ticket inspector requests the passenger to pay additional charge and amount due for a ride and in case of refusal, the inspector requests the passenger to produce the document confirming the passenger`s identity and issues the request for payment. The ticket inspector assesses the validity of the ticket on the basis of provisions included in Chapter II point 8 of the Regulations.
  9. An additional charge form should be completed in two copies – one for the passenger who should confirm a receipt of this copy by her/his legible signature on the other copy. If the passenger pays additional charge directly to the inspector, the fact of its payment is registered in the cash charge form.
  10. Passengers who are under 13 years of age are not given an additional charge form, however, this form is sent to their parents or guardians established during the inspection. The ticket inspector does not collect any additional charge from those passengers.
  11. Passengers have a right to lodge complaints and appeals against the decision resulting from the provisions of public transport services to the Director of Zarząd Transportu Miejskiego in Kielce. The complaints and appeal should be considered immediately, not later than within 30 days from the date of its filing.
